Q. What exactly can I claim for?
A. You can claim for any pain and suffering the injuries have caused you plus any loss of earnings, and expenses incurred such as care or travel costs. If an injury has resulted in a permanent disability this can also be claimed for.
Q. How long have I got to make claim?
A. Although you have 3 years from the date of the accident we would advise you make a claim as soon as possible whilst things are still fresh in your mind.
Q. Do I have to appear in court if I make a claim?
A. The majority of personal injury claims are settled out of court. However if one party does not agree liability it may result in the case going to court.
Q. Who pays the compensation?
A. The person who injured you, but usually their insurance company.
Q. What if they are not insured?
A. In road traffic accidents with non insured drivers the MIB (Motor Insurers Bureau) will pay compensation. The CICA (Criminal Injuries Compensation Authority) pay compensation to victims of a violent crime.
Q. Can I make a personal injury claim on behalf of my child?
A. Yes you can. Any compensation that is awarded to the child is usually invested on their behalf until they reach their 18th birthday.
