Special Damages

Any actual losses that you have incurred, for example loss of earnings, medical expenses, costs of travel and help around the home may be claimed for. Things like these are known as ‘Special Damages’.

These are to put you in the financial position you would have been in had the injury not taken place. It can also include the cost of any equipment or care that is needed following your injury. Benefits in kind such as company car and company mobile phone that were allowed for personal use may also be claimed for if you lose your job as a result of your injury. If you were involved in a car accident, this could also include the cost of having to hire a replacement car. However, if you drove a mini prior to the accident hiring a flash sports car would not be paid for. The cost of a similar replacement vehicle is what would be expected to be repaid.

Future losses could also be looked at under special damages. If you did lose your job because of your injury there could be a loss of future pension rights and increased earnings if there were promotion prospects for you.

In the result of a fatal accident or injury expenses like funeral payments and compensation for any dependent family can be claimed.
