Pedestrian Accidents

Whilst there are thousands of accidents on the road each year involving other drivers there are also many pedestrians injured through the actions of vehicle drivers too. All drivers owe a duty of care to pedestrians and must ensure they drive safely to avoid injuring pedestrians.

Sometimes pedestrians do not have as good visibility as a driver has and because of this can suffer injuries in road accidents. One example of this was where foliage had been allowed to grow in the middle of a dual carriageway which restricted the visibility of a woman who was crossing the road. She failed to see an approaching vehicle and was knocked down suffering severe injuries. The highways agency was found to be partially responsible for the cause of the accident.

Drivers who mount the pavement when parking sometimes cause an accident. Cars parked on pavements will also mean a pedestrian will have to walk onto the road to pass the parked vehicle which is dangerous and can cause an accident. If a pedestrian was injured in a situation like this the owner of the vehicle could be responsible.

In busy town and city centres there will always be lots of people out and about on the streets so more care should be taken when driving in areas like these. Speed restrictions should be adhered to but common sense should tell you to drive more slowly when there are lots of pedestrians crossing, whoever has right of way.

Just as in any road accident a pedestrian will still need to be able to show that the accident was caused by the motorist. It is important to get the drivers name, address and vehicle registration where possible and details of any witnesses.
