Failed vasectomy and sterilisation
Each year thousands of men choose to have a vasectomy, and many women choose to be sterilised, usually because they have a complete family and do not want any more children. The majority of the time these operations are successful but sometimes sadly they are not.
Negligence claims regarding a failed vasectomy usually fall into one of the following types:
Failed operative technique
This is when the tubes are not cut correctly during surgery
Incorrect advice given after the operation
It can take around four months following surgery for the sperm to completely disappear from the semen. Test should be carried out until the semen is shown to be completely clear. Patients should be advised to use contraception until they have been advised they are clear.
Negligence claims regarding failed sterilisation
During this operation the fallopian tubes are either clamped or cut. This is to stop the eggs travelling to the ovaries. When the clips are not secured properly during the operation they can come free meaning the sterilisation will not have worked.
When one of the above happens and it results in a pregnancy a claim can be made for wrongful birth.
