If you are unhappy with the medical treatment you have received there are things you must do before the claim process can begin.
The first thing you should do is ask for a written explanation about what happened. The doctor or medical professional involved with your treatment should speak with his/her manager who will need to investigate the matter by interviewing staff and looking at your medical notes. Following this you should be given a full written explanation.
Only if you are not satisfied with the explanation given should you then contact a company to look at making a claim.
The solicitor handling your case will need to see your medical records as these will detail all the medical steps taken in relation to your complaint including any advice and treatment given, or not given. You are entitled to see them as they are your records. But if you sign a letter authorising your solicitor to see them the hospital or GP can release the records to the solicitor. You must state in your letter that you are contemplating a compensation claim against them, but they still have to provide your medical records to the solicitor.
Your solicitor should then consult with a medical expert as to whether they think medical negligence has occurred. If it has, the solicitor will notify the hospital, GP or medical professional that a claim for compensation against them will be started.
