Professional Negligence
Anyone offering a professional service has a duty of care to the person they are providing the service for. Because professionals are qualified in their field we trust what they tell us, after all that is where the expertise is. For example, who would question the advice a solicitor gave, or the plans an architect drew up for you. However, professional negligence does happen, and when it does you are entitled to claim compensation.
Let’s look at some examples of professional negligence and the effects of this:
Plastic Surgeons-Many people go abroad for plastic surgery to save money. Unfortunately a lot of the plastic surgeons operating abroad are not registered and operate illegally which results in many botched operations, sometimes even fatal. Failing to check a patient’s medical history, or not advising a patient of the risks involved would be negligent acts. Not only can it have devastating effects on the patient but it can cast a cloud over the whole plastic surgery industry and affect the business of legitimate registered plastic surgeons.
Mortgage Advisors-Most earn commission from the lenders they secure clients for, so if a mortgage advisor sold you a mortgage that wasn’t the best for you but did earn him good commission this would be classed as professional negligence. The effects of this would result in you repaying more than you needed to for the mortgage.
Accountants-A good example would be an accountant failing to submit your tax return which results in you receiving a large fine.
Surveyors-If a surveyor did not spot damages to a property, or failed to report them it would affect the value of the property being surveyed, this would be professional negligence.
Gas Fitters-There have been many cases of gas fitters advertising their services but are not qualified to provide them. This is against the law and the results can be fatal. Whenever a gas engineer carries out work on your property they must be on the Gas Safe Register, this is the law.
Most professional bodies have guidelines and standards that their members must adhere to. Failure to meet those standards can mean a compensation claim being filed against them.
